Terms and Conditions
1. The contest will be known as “Khull Ja Sim Sim” or any other name as desired by BIG Magic Limited (hereinafter referred to as “Big Magic/ Organizer”).
2. Participant/s must have an account on Facebook, be 18 years or above of age and a citizen of India to particate in the Contest (“Participant”). Employees of Big Magic or its affiliates, their immediate families, contest organizers, their immediate families are not eligible to participate in the contest.
3. Big Magic will run 2 (Two) types of contest (1) Daily Contest and (2) Weekly Bumper Contest. Contest will run from 12 noon on day one till 12 noon on the next day. However Big Magic may extent the duration of Daily Contest and Weekly Bumper Contest. Information with regards to the contest question will be given on the Facebook page and/ or during the show “Khul Ja Sim Sim”.
4. One winner per contest would be chosen based on the correct answer given by him/her on the Big Magic Facebook page who will get a merchandise from Big Magic.
5. The final decision on the winner of the contest will be solely taken by Big Magic. Big Magic reserves the right to disqualify any participant that does not meet the criteria that Big Magic may set.
6. There is no participation fee.
7. The prize is not transferable; no prize substitutions or cash alternatives will be allowed.
8. Big Magic shall neither be responsible for any fake or fictitious profile on Facebook nor shall check the authenticity or credentials of the winner. Big Magic shall presume that all data/information provided by the profile owner is authentic and true.
9. Big Magic shall not be responsible for any loss or damage if it has to discontinue or cancel the Daily Contest and/ or Weekly Bumper Contest in compliance with any law, ruling, order, regulation, requirement or instruction of any Central/State Government or for any other unavoidable reason beyond its control. The participants shall be informed of such discontinuance/ cancellation at the earliest.
10. By entering the contest, the Participant agrees to be bound by these terms and conditions.
11. For a Participant to be eligible to participate in the contest, he/she must be a resident of India and not lesser than the age of 18 years as on 13th September 2012.
12. To participate in the contest, the participant has to visit the Big Magic Facebook page and answer the questions asked on the page. The winner will be selected based upon the correct answer. In case there is more than one participant who has given correct answer then, Big Magic shall at its discretion decide the winner.
13. Big Magic is not responsible for participant not being able to understand the Contest mechanics or for his/ her interpretation of the same. No correspondence in this regard will be entertained.
14. Big Magic may use winners’ profile’s image or link to profile for reference to declare the winners’ name. The name on the winner shall be published on the Facebook page of Big Magic or may be communicated to the winner by email or on their facebook page as may be deemed fit by Big Magic. The winner of the contest shall collect the prize from Big Magic. Profile image of the winner shall be used / referred on the Big Magic page. Winner/ Participant hereby gives his/her consent to Big Magic for using the same for the stated purposes.
15. The Participant agrees that Big Magic has the right to share, publish and distribute these images anywhere on their platform or platforms of their sister concerns.
16. Big Magic shall not be liable to make any payment towards any expenses which is incurred by the participant/ winner whatsoever.
17. The contest is in no way sponsored, endorsed or administered by, or associated with, Facebook. You understand that you are providing your information to BIG Magic Limited and not to Facebook.
18. Participant Confirms and Acknowledges that once the answer is submitted the same cannot be withdrawn by the Participant for any reason whatsoever.
19. All answers are subject to verification, including without limitation, verification of eligibility through checks as deemed appropriate by Big Magic and complete compliance with these Terms and Conditions. Big Magic has the sole right to disqualify any Image/ Entries/ Participants if the same is not in compliance with the Terms and conditions herein Specified or any further applicable laws, regulation/ or any Policies that may be specified by the Big Magic.
20. All response mechanisms depend on performance of third parties; Big Magic does not take any responsibility of failures occurring with the same. Big Magic shall not be in any way held responsible for any corrupted/ lost or delayed Images/Entries or any other manner which may cause Participants to lose or delay his/ her chance to participate in the Contest.
21. Entries received outside the specified times and procedure will be disqualified.
22. Big Magic reserves the right to cancel, terminate or suspend the contest with or without any prior notice. For the avoidance of doubt, cancellation, termination or suspension by Big Magic of the Contest shall not entitle the Participants to any claim or compensation against Big Magic for any and all loss or damage suffered or incurred by the Participants as a direct or indirect result of the said act of cancellation, termination or suspension.
23. All taxes, if any, which will incur on the participants and/ or winner will be borne by the participants and/ or winners alone and Big Magic shall not be liable to bear the same. The participants and/ or winners undertake deposit the same with Big Magic.
24. As mentioned above, it is hereby reiterated that Big Magic decisions on all matters relating to the Contest will be final and binding on all Participants and no further correspondence or attempts to dispute the Award nomination Process will be entertained.
25. None of the provisions of these Terms and Conditions shall be deemed to constitute a Partnership or Agency between Participants and Big Magic and Participants shall have no authority to bind Big Magic in any manner whatsoever.
26. Big Magic accepts no liability for any errors or omissions, whether on behalf of itself or any Third Parties.
27. In no event Big Magic shall be liable for losses or any incidental or consequential damages arising out of or in connection with the Contest, its services or this Agreement (however arising, including negligence). Big Magic shall not be responsible for any Product or Service liability of any kind.
28. Participants shall be solely responsible for any consequences which may arise due to any kind of Infringement of Copyrights or any kind of Intellectual Property Rights belonging to any other Person / Entity etc. and also undertake to indemnify Big Magic its Directors, Officers, Employees, etc. on the happening of such an Event (including without limitation cost of Attorney, Legal Charges etc.) on full indemnity basis.
29. The information is deemed to be voluntarily supplied during the course of Participation and personal information provided by the Participants will be deemed as non-confidential, which hereby discharges all obligations of confidentiality. Big Magic shall be free to reproduce, use, disclose and distribute the information to Third Parties without limitation.
30. Notwithstanding anything to the contrary contained in this terms and conditions and any circumstances whatsoever, Big Magic shall not be liable for any incidental, ancillary, direct, indirect, special or consequential damages including but not limited to lost profits or injury or death, whether in contract or based on any theory of liability.
31. Big Magic hereby informs and Participants herein agree and represent that Big Magic has the sole right to use the said Contest in any manner including but not limited to promote / telecast / distribute / re-distribute / exploit the same in any form or through any medium known now or invented in future. Participants irrevocably, unilaterally and unconditionally grants all his/her moral rights (if any) to Big Magic in respect of the said contest.
32. If the operation of the contest (including without limitation the operation of the internet/ telephone system) or the contest is prevented by Force Majeure event, Big Magic may cancel all or any part of the contest without any liability to any person whatsoever.
33. These Terms & Conditions / Agreement are subject to the prevailing Laws of India. All disputes, differences and claims arising out of the same shall be subject to Indian Law.
34. In case of disputes with respect to the contest, the matter shall be referred to a sole arbitrator to be appointed by Big Magic. The arbitration shall be at Mumbai.
35. Participant consents to the exclusive Jurisdiction and venue of courts in Mumbai, India in all disputes arising out of participation or any of the Terms and Conditions set out herein.
